 note = {本稿では、子どもの権利条約制定30年、日本が子どもの権利条約を批准して25年の節目に、今日の就学前の教育・保育を取り巻く現状の中で、果たして子どもの権利条約に示される子どもの権利が保障されているのかを検証することを目的とした。特に、子どもの生活の場である保育の現場で、子どもの権利が保障されているのかどうかということを検討するために、まず、子どもの権利について子どもの権利条約から整理した。さらに、第２次世界大戦直後に出された「保育要領」における子どもの権利保障と、平成30年に改訂された幼稚園教育要領、保育所保育指針における子どもの権利保障について検討し、子どもの権利保障のありようを比較検討した。また、今日の保育を取り巻く現状にかかわる子どもの権利の保障の課題を検討し、子どもの権利を保障するための保育者や大人のかかわりについての整理ができた。, In this paper, 30 years after the establishment of the Convention on the Rights of the Child, and at the 25th anniversary of the ratification of the Convention on the Rights of the Child, we are in the current situation surrounding today's pre-school education and childcare.
